EVIDENCE CRUCIAL IN CAPITAL CASES
A major safeguard is required before a
death penalty is pronounced. Judges
must ensure all prosecution evidence,
duj to the defence, is available to
them at the earliest opportunity, both
before and during the trial.
Too many miscarriages have occurred due
to the prosecution withholding or
obscuring pertinent evidence.
Judges must ensure rules are obeyed
and guilty parties criminally charged.
